Unit Patent and European Patent Court

The DPMA: In German Patent- and Trademark Office (DPMA) today was a seminar on “The European Patent Package” instead. Jointly organized by the German Association for Intellectual Property and Copyright (Wheat), the Oxford University Press (OUP) and the DPMA organized event is one of two seminars, which initiated the publication of the partnership journals IIC-International (GRUR-Int.) und Journal of Intellectual Property Law & Practice (JIPLP) form.

Representatives of the IIC, des JIPLP, the case law and science spoke about the recent developments at EU level in the creation of a unit patent and a European patent court. The panel discussion took advantage of the approximately 200 Participants from the legal profession, the economy, interest groups, of science, the judiciary and the DPMA and the EPO (EPA) to discuss issues and to exchange views.

The so-called “EU-Patentpaket”, consisting of the EU Patent Regulation, EU language regulation and the agreement creating a Unified Patent Court, was the end 2012 approved in Brussels. The regulations stipulate, that a patent granted by the EPO EU patent at the request of a uniform protective effect in the current 25 unfolds participating EU Member States. Changed translation requirements should bring cost savings for Applicants and Applicants with it. The regulations are not expected before 2015 In Kraft treten, because at least initially 13 States, including Germany, Britain and France, must ratify the Court Agreement.

The first seminar of the series took place in late January 2013 about “Secondary Protection for Innovation in Germany: Problem or Solution?” in London statt.
